Notice is hereby given that the City Council of the City of Omaha met on July 23, 2019 and passed and approved the ordinances entitled:
ORDINANCE NO. 41892
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located south of HWS Cleveland Boulevard and west of 198th Street from AG-Agricultural District to R4-Single-Family Residential District (High Density). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 1, Falling Waters North, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from AG-Agricultural District to R4-Single-Family Residential District (High Density). Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 41893
AN ORDINANCE vacating the portion of the north/south alleyway north of Shirley Street ending approximately 300 feet +/- north of the right-of-way of Shirley Street, abutting Lots 6-11, Block 4 of West Pacific Hills Addition, and Lot 2, Sunset Meadows Addition, subdivisions, as surveyed, platted and recorded in Douglas County; and providing the effective date hereof. WHEREAS, Neb. Rev. Stat. Section 14-375 provides that the City Council may vacate a street or alley without petition upon City Planning Board recommendation; and, WHEREAS, the Statute further provides that a Committee of Appraisers be appointed to appraise damages, if any, to property affected by the vacation; and, WHEREAS, Resolution No. 781 adopted June 13, 2017, appointed Chris Jerram, Aimee Melton, and Vinny Palermo members of the City Council, to assess damages to all property affected by the vacation; and, WHEREAS, on June 4, 2019, the Committee of Appraisers held a meeting immediately following the 10:30 a.m. staff meeting in the City Council Conference Room, Omaha/Douglas Civic Center, 1819 Farnam Street, Omaha, Nebraska, at which meeting no cause for any damages was found as a result of the vacation; and, WHEREAS, the City Council finds there are no damages as a result of this vacation, and that such vacation should be approved; and, WHEREAS, Fair Market Value has been received for the conveyance of the right-of-way to be vacated. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the portion of the north/south alleyway north of Shirley Street ending approximately 300 feet +/- north of the right-of-way of Shirley Street, abutting Lots 6-11, Block 4 of West Pacific Hills Addition, and Lot 2, Sunset Meadows Addition, subdivisions, as surveyed, platted and recorded in Douglas County; be, and hereby is, vacated and without further act of the City, title to the vacated right-of-way shall pass to the abutting owner of said property thereof; the vacating of the property herein described, and the reversion thereof, pursuant to applicable law, shall be subject to the conditions and limitation that there is reserved to the City of Omaha the right to maintain, operate, repair and renew sewers now existing therein and in the future to construct, maintain, repair and renew additional or other sewers; and also the right to authorize the public utilities and cable television systems to construct, maintain, repair or renew and operate now or hereafter installed water mains and gas mains, pole lines, conduits, electrical transmission lines, sound and signal transmission lines and other similar services and equipment and appurtenances above, on and below the surface of the ground for the purpose of serving the general public or abutting property; and the right so reserved shall also include such lateral connection or branch lines as may be ordered, desired or permitted by the City or such other utility and to enter upon the premises to accomplish the above purposes at any and all times. No buildings, improvements, or other structures shall be placed in, on, over, or across said vacated right-of-way without express written approval of the City. All vegetation upon the premises, including but not limited to, trees, bushes, and crops, and all structures upon the premises, including but not limited to, buildings, walls, fences, drives and walks, may be damaged or removed as necessary in the exercise of the rights herein reserved without compensation to any person. Section 2. That the property be divided as such; title of the southern 190 feet of the north/south alleyway north of the right-of-way of Shirley Street abutting Lots 7 and 8, Block 4 of West Pacific Hills Addition and Lot 2, Sunset Meadows Addition will be passed to the abutting property owner of 9118 Shirley Street, Mr. Paul J. Jedruski, and title of the northern 110 feet of the north/south alleyway north of the right-of-way of Shirley Street abutting Lots 6, 9, 10 and 11, Block 4 of West Pacific Hills Addition will be passed to the abutting property owner of 1715 South 91st Avenue, Mr. Zahi Zeidan. Section 3. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 41894
AN ORDINANCE to accept the bid of Solid Surface Care in the annual amount of $5,728.00, involving appropriations of more than one year as provided in 5.17 of the Home Rule Charter, to enter into a three-year price agreement for carpet cleaning services at nine (9) Omaha Police Department facilities, with two additional one-year options held by the City, and which may be done so administratively; to authorize the Finance Department to make payments from a specified account to Solid Surface Care for the cost of carpet cleaning services in accordance with the specifications; and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the bid of Solid Surface Care in the annual amount of $5,728.00 to enter into a three-year price agreement for the furnishing of materials, labor, equipment, and all else necessary to perform satisfactory carpet cleaning services at nine (9) Omaha Police Department facilities, with two one-year options held by the City, which may be done so administratively, is hereby accepted and the same hereby approved. Section 2. That the Finance Department is authorized to make payments to Solid Surface Care for the cost of such services at eight (8) Omaha Police Department facilities from the Omaha Police Department, General Fund 11111, Organization 113141 Fleet & Facilities, Account 42274 Janitorial Services. Section 3. That the Finance Department is authorized to make payments to Solid Surface Care for the cost of such services at the ninth facility, being the Public Safety Training Center, from the Omaha Police Department, General Fund 11111, Organization 113141 Fleet & Facilities, Account 42274 Janitorial Services and the Omaha Fire Department, General Fund 11111, Organization 114571, Account 42252 Contract Services. Section 4. That this Ordinance, not being of legislative character, shall be in force and take effect upon its passage.

SPECIAL ORDINANCE NO. 10263
A SPECIAL ORDINANCE LEVYING A SPECIAL TAX AND ASSESSMENT ON CERTAIN LOTS, PARTS OF LOTS AND PIECES OF REAL ESTATE IN THE CITY OF OMAHA, TO COVER THE COST OF SIDEWALK SNOW REMOVAL IN DISTRICT NO. SWSR 2018-03. WHEREAS: It having been and being hereby adjudged, determined and established that the several lots and pieces of real estate hereinafter referred to have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate, respectively, by reason of clearing snow and ice from such sidewalks along and adjoining the said lots and pieces of real estate. THEREFORE, for the purpose of paying the cost incurred for said snow and ice removal along and adjoined the said lots and pieces of real estate, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: SECTION 1. That the cost of clearing snow and ice from such sidewalks along and adjoining the several lots and pieces of real estate in the City of Omaha, herein described be and hereby is levied and assessed according to special benefits by reason of the clearing of snow and ice from such sidewalks upon the following lots and pieces of real estate, as shown by the maps and plats on file in the office of the City Engineer of said City, said costs being so levied on said lots and pieces of real estate, respectively. SECTION 2. The special tax levy shall be due and payable at the date of the levy. The special tax levy shall become delinquent fifty (50) days from and after the passage and approval of this Ordinance; from and after becoming delinquent shall bear interest at the rate of one percent (1.00) per month until paid. SECTION 3. That the entire amount of tax so levied and assessed on any of said lots, or the entire equal pro-rate proportion of said tax on any of said lots may be paid by any person on any part of said lots within fifty days from said levy and, thereupon, said lots or parts of lots shall be exempt from any lien or charge thereto. SECTION 4. That this Special Ordinance shall take effect fifteen days after its passage and be in force thereafter.

CITY of OMAHA
AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Modern Equipment Company for a renewal to their air emission operating permit for fabricated metal products manufacturing facility at 6161 Abbott Drive, Omaha. The potential emissions, in tons, for this project will be: PM10 23.1, PM2.5 23.1, VOC 80.0, individual HAP 2.0 and total HAPs 4.0.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from July 31, 2019 to August 31, 2019. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
