AN ORDINANCE to approve a Mixed Use District Development Agreement for property located southeast and southwest of 192nd Street and West Dodge Road between the City of Omaha and Jasper Stone 192nd and Dodge LLC, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health safety, and welfare, desires to assure that the property located southeast and southwest of 192nd Street and West Dodge Road is developed in accordance with the provisions of the Mixed Use District Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Mixed Use District Development Agreement is hereby approved. Section 4. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 41890
AN ORDINANCE providing for the designation of an enhanced employment area; the levy of a general business occupation tax; providing for the administration, imposition and collection of such occupation tax; specifying the use of such occupation tax revenue; and related matters. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA, NEBRASKA: Section 1. Findings and Determinations. Pursuant to the Nebraska Community Development Law, Nebraska Revised Statutes §§ 18-2101 et. Seq., as amended (the "Act"), and specifically Neb. Rev. Stat. §18-2142.04, Chapter 19, Article XVII of the Omaha Municipal Code ("General Enhanced Employment Tax") provides for the establishment of an enhanced employment area for the purpose of paying all or any part of the total costs and expenses of the authorized work within an enhanced employment area. The City is authorized to levy and collect a general business occupation tax upon businesses and users of space within an enhanced employment area for the purpose of paying for all or any part of the total costs and expenses for the "Authorized Work" of a development project, as allowed by the Act and defined in Neb. Rev. Stat. §18-2142.04 and the General Enhanced Employment Tax, within such enhanced employment area. The City Council hereby designates the property legally described and illustrated in Exhibit "A" (attached hereto and incorporated herein by reference) as an "enhanced employment area" as defined in Neb. Rev. Stat. § 18-2103(22), as amended (the "Enhanced Employment Area"), as allowed by the Act and the General Enhanced Employment Tax. Pursuant to the authority granted by Neb. Rev. Stat. §18-2142.04, as amended, and the General Enhanced Employment Tax Code, and at the request of the property owner owning all property within the Enhanced Employment Area, the City Council determines that it is necessary, desirable, advisable and in the best interest of the City that the City be empowered to levy a general business occupation tax within the Enhanced Employment Area for the purposes set forth in the Act and Chapter 19-901 (b) of the Omaha Municipal Code. The City Council further determines that based upon written undertakings provided by the property owner and the developer, the new investment in the enhanced Employment Area Satisfies the employment requirements of the Act. Section 2. Occupation Tax Imposed; Collection of Occupation Tax. Commencing upon the issuance of a Notice of Commencement, as defined in the Development Agreement for Occupation Tax in an Enhanced Employment Area between the City of Omaha, a municipal corporation, and Jasper Stone 192"d and Dodge, LLC, a Delaware limited liability company (the "Development Agreement"), and in each calendar month thereafter until the expiration of the Tax Period, as defined in the Development Agreement, there shall be imposed a general business occupation tax upon each and every person operating a business within the Collection Area of the Enhanced Employment Area (the "Occupation Tax"). The amount of such Occupation Tax shall be based upon the following business uses taking place within the Enhanced Employment Area: 1. 1.75% of gross room revenues of all hotel businesses located in the Enhanced Employment Area; 2. 1.75% of food and beverage sales of all restaurants located in the Enhanced Employment Area; 3. 1.75% of gross retail sales or sales of services for businesses located in the Enhanced Employment Area; 4. $0.55 per square foot (gross) (which shall increase 2% per year compounding commencing the effective date of this Ordinance) of commercial office space; 5. Residential space: none; and 6. Garage retail: none. Such Occupation Tax shall be imposed upon the gross receipts resulting from the sale, lease, or rental of any products, rooms, units, or services within the Enhanced Employment Area, as indicated for the business uses listed above, except that such tax shall not be imposed upon any transaction which is subject to tax under Sections 53-160, 66-489, 66-489.02, 66- 4,140, 66-4, 145, 66-4, 146, 77-2602 or 77-4008, or which is exempt from tax under Section 77- 2704.24 of the Nebraska Revised Statutes, as amended. The amount of the Occupation Tax shall at all times be subject to such applicable rules and regulations imposed by the State of Nebraska Department of Revenue regarding the use and imposition of the general business occupation tax authorized by Section 18-2142. 02 of the Act. The person engaged in operating a business subject to the Occupation Tax may include the tax on or for the selling price, services rendered, charges incurred, rates, or other consideration received on a bill, statement, receipt, or other similar invoice to the purchaser, but each person engaged in a business shall remain liable for the Occupation Tax imposed by this Ordinance. Section 3. Tax Cumulative. The levy of the Occupation Tax under this Ordinance is in addition to all other fees, taxes, excises and licenses levied and imposed under any contract or any other ordinances of the City, in addition to any fee, tax, excise or license imposed by the State of Nebraska or the federal government. Payment of the Occupation Tax imposed by this Ordinance shall not relieve the person paying the same from payment of any other tax now or hereafter imposed by contract or ordinance, including those imposed for any business or occupation in which he or she may participate, unless otherwise specified therein. The Occupation Tax imposed by this Ordinance shall be cumulative, except where otherwise specifically provided. Section 4. Use of Revenue. The Occupation Tax imposed by this Ordinance, less any administrative expense, shall be used to fund any expenditure that is lawfully authorized to be made under the Act and this Ordinance in connection with the development project located within the Enhanced Employment Area. Section 5. Sunset Provision. The Occupation Tax for each Collection Area shall automatically expire upon the conclusion of the Tax Period, as defined under the Development Agreement. Section 6. Effective Date. This Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 41888
AN ORDINANCE extending the limits of the City of Omaha over certain land in Douglas County, Nebraska, and incorporating the same into and making the same a part of the City of Omaha and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the corporate limits of the City of Omaha be extended over and that there be included therein the following described lands in Douglas County, Nebraska, which presently adjoins the City Limits of the City of Omaha, as it now exists: Beginning at a point on the existing city limit line to the City of Omaha as established by Ordinance no. 41544, passed August 14, 2018, said point being the intersection of the East right-of-way line of 168th Street with the South right-of-way line of Dora Hamann Parkway; thence Westerly to the Northeast corner of Outlot “C”, Manchester Park, a subdivision as surveyed, platted and recorded, in Douglas County, Nebraska; thence South along the East line of said Outlot “C”, a distance of 99.23 feet, to the Southeast corner of said Outlot “C”; thence along the South line of said Manchester Park Addition on the following described thirty-two courses; Thence N46°50’54”W, a distance of 88.46 feet; thence S47°02’53”W, a distance of 235.90 feet; thence Northwesterly on a curve to the left with a radius of 175.00 feet, a distance of 16.98 feet, said curve having a long chord which bears N45°43’56”W, a distance of 16.98 feet; thence Northwesterly on a curve to the right with a radius of 225.00 feet, a distance of 55.43 feet, said curve having a long chord which bears N41°27’16”W, a distance of 55.29 feet; thence S88°12’41”W, a distance of 201.92 feet; thence N80°27’15”W, a distance of 133.26 feet; thence N69°22’10”W, a distance of 148.31 feet; thence N68°12’38”W, a distance of 54.13 feet; thence N42°07’56”W, a distance of 140.35 feet; thence S57°54’58”W, a distance of 149.44 feet; thence S87°20’41”W, a distance of 525.41 feet; thence N14°08’06”E, a distance of 144.06 feet; thence Northwesterly on a curve to the right with a radius of 303.00 feet, a distance of 7.20 feet, said curve having a long chord which bears N75°10’55”W, a distance of 7.20 feet; thence Southwesterly on a curve to the left with a radius of 175.00 feet, a distance of 131.94 feet, said curve having a long chord which bears S83°53’58”W, a distance of 128.84 feet; thence S62°18’03”W, a distance of 78.48 feet; thence Southwesterly on a curve to the left with a radius of 275.00 feet, a distance of 170.27 feet, said curve having a long chord which bears S44°33’48”W, a distance of 167.56 feet; thence S26°49’34”W, a distance of 26.36 feet; thence Southwesterly on a curve to the left with a radius of 275.00 feet, a distance of 16.30 feet, said curve having a long chord which bears S25°07’40”W, a distance of 16.30 feet; thence N66°34’14”W, a distance of 170.00 feet; thence S23°25’46”W, a distance of 25.26 feet; thence S87°22’19”W, a distance of 118.52 feet; thence S15°20’16”W, a distance of 4.54 feet; thence N81°02’25”W, a distance of 121.17 feet; thence S08°57’35”W, a distance of 38.92 feet; thence N81°02’26”W, a distance of 50.00 feet; thence N08°57’35”E, a distance of 105.09 feet; thence Northerly on a curve to the left with a radius of 175.00 feet, a distance of 35.48 feet, said curve having a long chord which bears N03°09’08”E, a distance of 35.42 feet; thence N02°39’19”W, a distance of 162.19 feet; thence Northerly on a curve to the right with a radius of 125.00 feet, a distance of 33.36 feet, said curve having a long chord which bears N04°59’25”E, a distance of 33.26 feet; thence N77°21’50”W, a distance of 151.65 feet; thence S69°40’20”W, a distance of 81.96 feet; thence S87°03’23”W, a distance of 91.35 feet to a point on the West line of the Southeast Quarter (SE 1/4) of Section 9, Township 15 North, Range 11 East of the 6th P.M., Douglas County, Nebraska;, thus ending described courses; thence South along said West line of the Southeast Quarter (SE 1/4) and said line extended southerly, to its intersection with the South right-of-way line of Biondo Street; thence Easterly along said South right-of-way line, to its intersection with the East right-of way line of said 1681h Street; thence Northerly along said East right-of-way line, to its intersection with said South right-of-way line of said Dora Hamann Parkway, said point being the point of beginning. A map of the area is attached hereto, marked "Exhibit A", and by this reference made a part of this Ordinance. The land to be annexed is marked thereon, but said map is for convenience and, in case of discrepancy, the description in this Section shall be controlling. The said territory upon the taking effect of this Ordinance shall be and become incorporated into, merged in, and be a part of the City of Omaha, Nebraska, and subject to the jurisdiction thereof and to its laws and ordinances. Section 2. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage. Section 3. That pursuant to NEB REV STAT §14-201.03 (Cum. Supp.2006) and NEB REV STAT§ 32-553 et. seq. (Reissue 2004), the lands annexed by the City of Omaha as described in Section I above shall be assigned to Omaha City Council District No. 7.

A map of the area is attached hereto, marked “Exhibit A”, and by this reference made a part of this Ordinance.
