NOTICE OF MEETING
CITY OF VALLEY
BOARD OF ADJUSTMENT
Notice is hereby given that the Board of Adjustment of the City of Valley, Nebraska, will meet on Monday, August 21, 2023, at 4:30 p.m. at the Valley City Hall (Council Chambers) located at 203 N. Spruce Street, Valley, Nebraska.
The purpose of the meeting is to consider a request for a variance from Article 7, Section 7.02.21 which requires storage of any boat, boat trailer, camp trailer, recreational vehicle, or other vehicle shall not be permitted in any required yard; except that a boat, boat trailer, camp trailer may be placed on concrete or asphaltic concrete surfacing in a side yard or rear yard.
The purpose of the meeting is to consider a request for a variance from Article 12, Section 05 which requires design standards for designated commercial areas.
An agenda kept continually current is available for public inspection at the office of the City Clerk at 203 N. Spruce Street, Valley, Nebraska.

MINUTES
REGULAR MEETING
August 8, 2023
Mayor Grove called the meeting to order at 7:00 p.m. Present were Mayor Grove; council members, TenEyck, Lewis, Batcher and Ueckert. Also present: City Attorney Andrea Griffin, Christie Donnermeyer Deputy Clerk and City Clerk Cheryl K. Eckerman.
Mayor Grove noted the location of the open meetings act, and stated one copy of all reproducible written material to be discussed at this meeting is available for examination or copying.
The Pledge of Allegiance was recited.
Proof of Publication was on the council desk.
Mayor Grove stated that at this time, any individual may speak on any issues on the agenda or on any agenda items that do not include public hearings. Comments are limited to three minutes for each individual. Visitors may state their comments and should not expect the Council to engage in back and forth dialogue regarding the comments. Unless an agenda item includes a public hearing, no visitors may speak during the business portion of the meeting.
Cole Williby, 422 S. Mayne St., Valley, NE., spoke for three minutes stating concerns regarding weeds, taxes and water billing and meters.
Council member Batcher moved to approve the agenda. TenEyck seconded. All voted in favor. Motion carried.
Council member Lewis moved to approve the consent agenda. Ueckert seconded. All in favor. Motion carried. Council member Lewis moved to approve the Special Designated Liquor License requested by the Waterloo Valley Rec. Association for the Town Team Tournament to be held on August 20, 2023. Ueckert seconded. All in favor. Motion carried.
Ordinance No. 794 relating to Unsafe Structures was introduced and adopted. A true, correct, and complete copy of said ordinance is on file at city hall.
Council member TenEyck asked that the Still Water Lake Phase 2 Plat be laid over one week to the August 15, 2023 special meeting to allow more time for review. Lewis seconded. YES: TenEyck, Lewis, Ueckert. NO: Batcher. Motion carried.
Mayor Grove opened the public hearing on the Still Water Lake Phase 2 Final Plat. Cole Williby, 422 S. Mayne Street, Valley, NE. gave testimony stating that other items such as lift stations, water system, fire and police departments should be focused on before new developments are considered.
Mayor Grove closed the public hearing.
Council member TenEyck moved that the rezoning request for Still Water Lake Phase 2 be laid over one week to the August 15, 2023 special meeting to allow more time for review. Lewis seconded. YES: TenEyck, Lewis, Ueckert. NO: Batcher. Motion carried.
Mayor Grove opened the public hearing on the Still Water Lake Phase 2 Final Plat. No public testimony was given.

Council member Lewis moved that the Mixed-Use Development Agreement with Still Water Lake, LLC Phase 2 be laid over one week to the August 15, 2023 special meeting to allow more time for review. TenEyck seconded. YES: Lewis, TenEyck, Ueckert. NO: Batcher. Motion carried.

Council member TenEyck introduced, read and moved for passage of Resolution No. 2023-42 authorizing the reimbursement of $1155.00 to City of Valley. Batcher seconded. YES: TenEyck, Batcher, Ueckert. NO: Lewis. Motion carried.
Mike Adair, PeopleService, gave an update on water projects and related water issues.
Council member Lewis introduced, read and moved for passage of Resolution No. 2023-43 authorizing the payment of $109511.10 to Layne Christensen for the New Well 22-1 project. Batcher seconded. All in favor. Motion carried.
Council member Batcher introduced, read and moved for passage of Resolution No. 2023-44 authorizing the payment of $243168.75 to Spencer Management for concrete repair at the Pines, S. Lakewood and Waring Streets. TenEyck seconded. All in favor. Motion carried.
Council member TenEyck moved that the Authorization for Advertisement for Bids for Still Water Phase 2 be laid over one week to the August 15 special meeting to allow more time for review. Lewis seconded. All in favor. Motion carried.
The city attorney reviewed ongoing projects and developments.
The mayor reported on utility billing payment options, meter reader repairs and city hall roof replacement.
Upcoming items: Valley Days August 10-13, Planning Commission August 15, Budget Workshop Special Meetings August 15, 22 & 29, and Cemetery Board August 24.
